Nintendo Australia fines NSMB Wii uploader $1.5 million

Finally, Nintendo has been able to make a little money from New Super Mario Bros. Wii , a sequel to one of its old franchises, released this November. Nintendo of Australia announced that as the result of a federal court settlement, one Australian will be required to pay $1.5 million ($1.3 million USD) to Nintendo for loss of revenue due. This person was allegedly the first to upload New Super Mario Bros.

Report: Global PS3 market share increasing

You may have assumed this from the climbing PS3 sales Sony reported last week, but a report from Research and Markets provides further confirmation that the system is increasing in popularity around the world. “The PS3 is dominant in Japan and Korea,” the report notes, “and as of June 2008, has begun to outsell the Xbox 360 in Europe. It is also steadily increasing its market share in all other regions across the globe, including in the North American market.” The Xbox 360 is still ahead of the PS3 in North America. It’s worth noting that the increase in sales in Europe predates the price drop and introduction of the PS3 Slim. Research and Markets also provided a bit more information about the distribution of console sales

Max & the Magic Marker scribbles down March US WiiWare release

Danish developer Press Play would like to draw everyone’s attention to Max & the Magic Marke r’s US release on WiiWare this March. The game released late last month on European WiiWare for 1,000 Wii Points. M&TMM is currently available in the US, directly from Press Play and digital distributors, for PC and Mac at a suggested price of $20. Codemasters denies US closures, admits layoffs

IGN reported yesterday that Codemasters , after disappointing stateside sales last year, was laying off staff at its U.S. office and was planning on shuttering it. But according to an official statement from the company, the story’s only half right: Though six employees were laid off (three from marketing, three from elsewhere), Codemasters told Edge there are no plans to close the U.S.

Take Two sells Jack of All Games

Take-Two announced the sale of Jack of All Games to software distribution mega-company Synnex . Jack of All Games, acquired by Take-Two in 1998, distributes games published by Take-Two (and its various brands) to retail. The sale is expected to be completed sometime in the first quarter of 2010, and will cost Synnex “$43.25 million, including $36.50 million in cash and up to an additional $6.75 million based on the achievement of certain items.” In the announcement, Take-Two CEO Ben Feder indicated that the company will continue to work with Jack of All Games after the sale.

Netflix details PS3 disc distribution for November, ‘confident’ it’ll have ample supply

Netflix is confident that it will have ample supply in November for every PS3 user who requests a disc for its recently announced streaming service. Speaking with Joystiq, Netflix Vice President of Corporate Communications Steve Swasey wouldn’t disclose the number of reservations the company has received for the free PS3 Netflix disc since the company announced the program on Monday, but did emphasize, “We’re confident we’ve produced enough discs.” Distribution centers apparently already have the units. Swasey told us that the company is still hammering out the distribution details, but the plan is to send out a press release sometime in November announcing that the discs have shipped. Customers should receive the red envelope in about the same time it usually takes for a Netflix shipment to reach them.

Square Enix to distribute Disney Interactive titles in Japan

The long-standing partnership between RPG juggernaut Square Enix and the mouse-eared moguls of Disney just became a bit stronger. According to Andriasang , Squeenix and Disney Interactive Studios have teamed up to distribute the latter’s games in Japan. The first title receiving the support of the massive publisher is Stitch! DS Ohana to Rhythm de Daibouken , which we’re assuming is a game based on the Lilo and Stitch franchise, and not some sort of sartorial rhythm title. Though you may be uncomfortable with the expansive publishing empire Square Enix is amassing, think of it this way — we could see awesome mash-ups between these two companies’ respective franchises! Like, say, an action-RPG featuring both Final Fantasy and Disney film characters — oh, never mind. That’s just silly talk

Look at all that juice: Gears of War ‘Imulsion’ energy drink

Ignore the fact that Gears of War ’s “Imulsion” wasn’t meant for consumption and has mutagenic properties : some clever company is bottling the stuff and selling it as an “energy drink.” Not only that, but at $4 (a can?) — with $5 shipping — we’d better see a Pendulum War break out from the distribution and sale of this stuff. Oh well, if anybody does start mutating, we can always try to subdue it through the use of the Resident Evil T-Virus Energy Drink , which we’re almost positive was actually meant to suppress the zombie outbreak caused by Avon’s Derma-full face cream . We’re all doomed
